1. Scope and Applicability:
This policy applies to all Academy LMS (hereinafter “Academy”) users and account holders including students/ learners, faculty, consultants, experts, affiliates, HCLTech staff and guests access/visitors using the Academy LMS portal and its resources. By using LMS and learning resources within the system and course you consent to the terms herein.

2. This acceptable use policy is intended to ensure:
• that Academy LMS account holder will be responsible users and stay safe while using the internet and other digital technologies for educational, personal and recreational use.
• that Academy LMS systems and users are protected from accidental or deliberate misuse that could put the security of the systems at risk.

3. Acceptable Use Policy Agreement
• I understand that I must use Academy LMS in a responsible way, to ensure that there is no risk to my safety or to the safety and security of the systems and other users. I recognize the value of the use of digital technology as a part of my learning at the Academy by HCLFoundation.
• I understand that if I fail to comply with this acceptable use agreement, I may be subject to disciplinary in line with the disciplinary process. This could include loss of access to the Academy LMS and other sanctions and in the event of illegal activities, involvement of the police or government authorities.

4. The Academy shall attempt to ensure that users and account holders have good access to digital technology to enhance their learning and will, in return, expect students to agree to be responsible users.

5. The Academy or HCLFoundation will not be responsible for any unauthorized action/communication channels established outside the portal.

6. The user or account holder shall ensure that the use of Academy LMS and the learning resources must be:
• mindful of the shared nature of the learning resources and impact on the ability of others to not circulate freely.
• consistent with the purpose of the resources, namely the academic and capacity-building mission of the Academy by HCLFoundation for professionals.
• Only upon credits are given to the Academy by HCLFoundation while using the resources in allelectronic print communications.
• In Compliance with local, state and national laws. The use shall alsoobserve copyrights, licenses, contracts, and HCLFoundation policies.

7. Prohibited practices include, but are not limited to:
• Sharing account or password with family members, friends and associates, guests and any members of HCLFoundation.
• Accessing or attempting to access resource/course resources for which you are not enrolled/ authorized.
• Transmitting or disseminating a virus, worm, Trojan horse or other harmful software/ links/ chats etc to fellow learners and course faculty and managers.
• Downloading, possessing, or sharing copyrighted materials in violation of the Indian copyright law of 1957.
• Transmitting unauthorized bulk communications (spam), on chats, mails, and forums with fellow learners and faculty.
• Sending forged, threatening, or harassing communications to other users/account holders.
• Using personal details of other users/account holders.
• Using Academy learning resources for commercial, for-profit, or promotional activities that are not related to HCLFoundation.
• Any other unauthorized use of the Academy learning resources.

8. I hereby consent and agree to the following Usage Terms:
• The LMS and devices are primarily intended for academic/educational use. The courses have been curated for only educational use and HCLFoundation will not be responsible for any practical/unauthorized application of it.
• I will not use them for personal or recreational use unless I have permission. I will comply with the policies and rules set down by the Academy by HCLFoundation. The username and password constitute a legal binding unique identity and I am responsible for any action, authorized or unauthorized, performed using my credentials.
• I understand that the Academy by HCLFoundation may monitor my use of the learning and communications systems. That the Academy may retain my data shared for the purpose of enrolment and monitoring data as per law.
• I will not try, unless I have permission, to make large downloads or uploads that might take up internet capacity and prevent other users from being able to carry out their work. I will respect others’ work and property and will not access, copy, remove or otherwise alter any other user’s files, without the owner’s knowledge and permission.
Furthermore, I will not misuse or share peers/fellow learners personal information with other users/ third party or external parties for any reason at all
• I will be polite and responsible when I communicate with others, I will not use strong, aggressive or inappropriate language and I appreciate that others may have different opinions.
• I will not take or distribute images of anyone without their permission.I will not research, promote or support extremist viewpoints that are in opposition to the Constitution of India or are in violation of any law in force.

9. I recognise that the Academy by HCLFoundatin has a responsibility to maintain the security and integrity of the technology it offers me and to ensure the smooth running of the Academy LMS:
• I will only use my own personal devices (mobile phones/USB devices etc.) to access Academy LMS, if I have permission. I understand that, if I do use my own devices, I will follow the rules set out in this agreement.
• I understand the risks and will not try to upload, download or access any materials which are illegal or inappropriate or may cause harm or distress to others, nor will I try to use any programmes or software that might allow me to bypass the filtering/security systems in place to prevent access to such materials.
• I will immediately report any damage or faults involving the resources, or system, however this may have happened.
• I will not open any hyperlinks in messages, forums, chats and emails or any attachments to emails, unless I know and trust the person/organisation who sent the email, or if I have any concerns about the validity of the email (due to the risk of the attachment containing viruses or other harmful programmes).

10. Termination of User Account
Academy by HCLFoundation reserves the right to edit/ disconnect/ disable/ terminate any user account, learning resource and service feature, without warning or prior notice on the following grounds:
• User account poses a security or performance threat or that otherwise violates Academy by HCLFoundation policies. Access may be later restored after the incident has been reviewed and the risk mitigated or eliminated. Accounts operating in violation of this policy may be frozen/ confiscated. Repeated or serious violations are grounds for permanent account loss or complete loss of account/ learning resources or complete course certification.
• Academy LMS services personnel are authorized to monitor logs and resources, investigate suspected violations. Violation of the terms of this policy constitutes a security risk and will result in immediate loss of access. When using Academy LMS on personal self-owned computers, devices and mobile devices, it is the owner’s responsibility to ensure that his or her device is fully updated and is protected against viruses, malware, and other threats. Should a computer or mobile device become infected or experience a problem which disrupts the Academy LMS site/ network, the user account will be disabled until the problem can be resolved to the satisfaction.

11. Consequences of Violation:
• Violations of this policy will be subject to disciplinary action including termination of user account or unenrollment from the course or referral to law enforcement where applicable. Students, faculty, consultants, exerts, staff, affiliates, and guests should be aware that prosecution and/or significant fines or financial penalties may occur if the law is violated.
• Blatant or repeat offenders will be reported to the appropriate authorities for action. Academy LMS users and account holders should be aware that the Academy by HCLFoundation will honor any legal requests for information pertaining to any violations.

12. Additional Obligations:
• This policy addresses common situations. Individuals are expected to use Academy LMS and its resources responsibly, whether or not there is a guideline addressing the specific situation.
• Additional limitations or prohibitions may exist in departmental facilities. Individuals are responsible for adhering to these policies and observing posted guidelines. Refer all inquiries to the specific department.
• The Academy LMS user and account holder shall faithfully, diligently and responsibly use the system and shall not involve in any form of misconduct, or commit any act subversive of discipline, or otherwise misbehave in such a manner, as would reasonably be constructed as giving the Academy by HCL Foundation any cause for terminating his services.

I confirm that I have read and understood the above document and agree to all statements contained within and to use the Academy LMS digital technology system on my own device/s within these guidelines, and in accordance with Academy by HCLFoundation on Information Security, Data Protection & Safeguarding, Misconduct & Data Breach.
